Examples of Workers' Compensation Noncompliance

Noncompliance refers to employers who are required to provide workers' compensation coverage and fail to do so.  In Missouri, an employer with five or more employees is required to have workers' compensation insurance.  The only exception is the construction industry.  They are required to provide coverage with one or more employees.

The law does not differentiate between full-time and part-time employees.  All must be counted.

The law does not state "Missouri" employees. If an employer has 2 employees in Missouri and 3 employees in Kansas, they would be required to provide workers' compensation insurance for the Missouri employees.

Corporations must count their officers in determining if workers' compensation insurance is required and must insure them.

Effective August 28, 2005 the 5 1/2 day rule has been rescinded. Once a non-construction employer has five or more employees, they are required to provide coverage.
