How to File an Appeal of a Workers' Compensation Case Decision

An application for review of an award from an administrative law judge in a workers' compensation case must be filed with the Commission within 20 days of the date of the award. This is done using the Workers' Compensation Application for Review to the LIRC form or by letter.

To file an appeal of the Commission's decision on a workers' compensation case, Form 8-C Notice of Appeal must be filed with the Commission within 30 days of the Commission's decision. The Commission will then forward the form to the court of appeals. A check for the docket fee of $70 should be made payable to the clerk of the appropriate appellate court and should accompany the Notice of Appeal.

If the appeal is to the Missouri Court of Appeals, Eastern District, an additional form is required. The Labor and Industrial Relations Commission Case Information Form must be completed and returned with the Notice of Appeal.

If the appeal is to the Missouri Court of Appeals, Southern District, an additional form is required. The Civil Case Information Form must be completed and returned with the Notice of Appeal.
