An aggrieved party may secure an appeal of the Commission's decision by filing a Notice of Appeal with the appropriate Missouri Court of Appeals. The Notice of Appeal must be filed with the Commission within the time prescribed. A check for the docket fee of $70.00 should be made payable to the clerk of the appropriate appellate court and should accompany the Notice of Appeal filed with the Commission.
Worker's Compensation - Appeals must be filed with the appropriate Missouri Court of Appeals within 30 days of the Commission's decision. §287.495 RSMo (as amended) A Form 8-C Notice of Appeal is used in filing appeals in Workers' Compensation cases. The form was promulgated by the Supreme Court and is governed by Court Rule 100.02.
If the appeal is to the Missouri Court of Appeals, Eastern District, an additional form is required. The Labor and Industrial Relations Commission Case Information Form must be completed and returned with the Notice of Appeal. Please follow instructions printed thereon.
If the appeal is to the Missouri Court of Appeals, Southern District, an additional form is required. The Civil Case Information Form must be completed and returned with the Notice of Appeal. Please follow instructions printed thereon.
Unemployment Insurance - An appeal to the appropriate Missouri Court of Appeals must be filed by mailing the appeal to the Commission within 30 days of the Commission's decision. Jurisdiction for all matters not involving a claimant, and those involving an out-of-state claimant, is the Missouri Court of Appeals, Western District. For all other matters, the appeal is to the Court of Appeals having jurisdiction over the county of the claimant's residence. § 288.210 RSMo (as amended). A Form 8-B Notice of Appeal is used in filing appeals in Unemployment Insurance cases. If you are an incorporated employer you must have an attorney licensed to practice law in the State of Missouri to file the Form 8-B on your behalf.The form was promulgated by the Supreme Court and is governed by Court Rule 100.02.
NOTE: Claimants for unemployment are not required to submit the $70.00 filing fee pursuant to § 288.380.5 RSMo (as amended).
